These general conditions of sale, governed by articles L.111-1 and according to the Consumer Code, determine the rights and obligations of the parties. By using this website or placing an order through it, you are consenting to be bound by these Terms and Conditions of sale. If you do not agree to all of the Terms and Conditions, do not use this website. By purchasing any product from https://www.yodibeauty.com, you enter into a contract with us on these terms.

2 – PURPOSE OF THE GENERAL TERMS AND CONDITIONS OF SALE

The general terms and conditions of sale described below detail the rights and obligations of YODI and its customer related to the purchase of any product through the brand’s website: www.yodibeauty.com. Please read through these Terms and our Privacy Policy prior to using this website.  This document sets forth arrangements for sale that are stated by Yodi and which the buyer must agree to. Yodi reserves the right to modify at any time these General Terms and Conditions of Sale (hereinafter, the "Terms"). By using this website and placing orders you are consenting to accept our General Terms and Conditions of Sale. The parties agree that their relationship shall be governed exclusively by this contract, to the exclusion of any other condition. The items offered for sale may not be transferred in any way whatsoever. All users of the site undertake to comply, without restriction or reservation, with these General Terms and Conditions of Sale, whether they visit it or place an order. The customer has to read through it before placing any order.  

3 – AVAILABILITY OF ITEMS

All orders through www.yodibeauty.comare subject to availability and in this regard, in the event of supply difficulties or because items are no longer in stock. As evidence of this, Yodi undertakes to inform the buyer as soon as possible by e-mail. If you do not wish to order substitute items you can get a refund or cancel your order. Any complaint by the customer concerning the order or delivery of an unavailable item will be considered unfounded. Yodi strives to describe the products offered for sale as accurately as possible. However, if errors may have occurred in this presentation, Yodi cannot be held liable.  Consumers who wise to receive further information about a product can contact our Customer Service: hello@yodibeauty.com Illustrations and photos of products display next to the text are not part of the contractual scope. Yodi ensures that the pictures of the products are as close as the one delivered to the customer. Under those circumstances, may Yodi be held liable for the photos.

4 – PRICE

The selling prices of the products available on the Yodi Website are in euros and include VAT. Nevertheless, the currency can change related to where the purchase is made. Prices are liable to be changed by Yodi at any time. This modification will be notified to the customers before any purchase. The prices on this website exclude delivery costs, which will be added to the total amount due. Shipping costs will be mentioned before the buyer confirm its order. A wide range of shipping methods are available on the site and can be modified at any time by Yodi. Any change in the applicable VAT rate will automatically be added to the price of the products sold by Yodi on its site.

5 –ORDER

Any order shows acceptance of these General Terms and Conditions of Sale, without prejudice to the specific contractual conditions concluded between the Parties. Before validating his order, the buyer can look over and check his shopping basket to correct any errors.

The distance selling contract is effective once the buyer confirms his order. Since then, we consider he has knowingly accepted these General Terms and Conditions of Sale. Consumer needs to pay to validate the order. He is fully aware of the prices, volumes, characteristics, quantities and, delivery times of the products ordered. The buyer is charged straight upon validation of the order. Once, the order has been accepted, the buyer is no longer able to cancel it. The sale will be final (on condition that the buyer doesn’t retract his order under the conditions provided by the Article 8 of these General Terms and Conditions of Sale). The buyer will get the confirmation of his order and receive an email when it will be shipped.

6 – TERMS OF PAYMENT

The price is payable in cash, in full on the day the order is placed by the customer through secure payment, according to the following terms and conditions: -       By credit card: Visa, MasterCard, American Express, other credit cards -       Through secure payment platform by Paypal Payment data exchanges are encrypted thanks to Ingenico tool. Bank data only circulates on the Internet in encrypted form and is never kept by the seller. The customer’s order may be subject to 3D secure verification. 3D secure is an authentication payment system that guarantees optimal security when shopping online. While the payment is being processed, the customer’s bank checks the identity of the bank card holder before validating the transaction. In order to prevent fraudulent practices, Yodi checks all the orders validated on the site. During this process, Yodi’s Customer Service may be required to demand customer to provide supporting documents, such as proof of address or the name of the person indicated for the delivery address, etc. Yodi will not be required to deliver the order to the customer if he doesn’t pay the full price in compliance with conditions indicated above. Late payment will result in all sums owed by the customer becoming immediately payable, without prejudice to any other action that the seller would be entitled to bring against the customer. Payments made by the customer will only be accepted after the reception to the sum due by the seller. Besides, Yodi reserves the right, in case of non-compliance with the terms of payment set out above, to suspend or cancel the delivery of pending orders placed by the Customer.   No additional costs, higher than the costs incurred by the Seller for the use of a means of payment may be invoiced to the Customer.

7 – DELIVERY

Delivery charges will be specified on the site, including all taxes, during the order process and must be approved by the customer while validating the order. They will appear on a specific line separate from the line specifying the price of the products. Delivery times are indicated on the Site and depend on the delivery method chosen by the customer. Delivery times exclude Saturdays, Sundays and public holidays.
In accordance with Article L. 216-1 of the Consumer Code, the parties agree that the order will be delivered within the time limits specified during order process and before being validated. Delivery times are also indicated in the order confirmation email sent to the Customer.
After this, you will receive an email from us confirming receipt of your order (the "Order Confirmation"). We will endeavour to fulfil your order for items listed in the shipping confirmation by the delivery date set out in the shipping confirmation. La Poste insures your parcel shipments. Speaking of this, delivery times can change regarding on the destination. If the delivery of orders is delayed by an event outside our control, then we will contact you as soon as possible to let you know the new delivery time. In accordance with Article L. 216-1, paragraph 2 of the Consumer Code, Yodi undertakes to respect the maximum period of 30 days from the conclusion of the contract. Delivery delays exceeded the 30-day legal framework cannot give rise to any penalty or compensation, nor to justify the cancellation of the order. As information, here are the usual delays provided by La Poste via Colissimo (after our products have been shipped): -       France: less than or equal to 5 working days
-       Europe: less than or equal to 8 working days. When home delivery requires a signature, this is proof that your package arrives at the intended audience.  The transfer of risks and liability relating to the Products takes place upon receipt of the Products by the Customer From this date, the client shall be solely and exclusively responsible for them, as well as for their use and any consequences that may result from them. As a result, the customer undertakes to check, at the time of delivery, that the delivered order is complete, compliant and has not been damaged.  When you receive the items, you may handle them to establish their nature, characteristics and functioning. Acceptable handling of the items is that which would reasonably be allowed in a shop. Items should not have been damaged, soiled, altered or used. If your handling goes beyond what is acceptable and the items are damaged or diminished in value, you can refuse to accept the order and to sign any supporting document. Any order received against signature by the customer shall be deemed to be in conformity, complete and in perfect condition at the time of delivery.

8 – RETURN & EXCHANGE

In accordance with article L221-24 of the Consumer Code, the buyer has 14 days to exercise his right of withdrawal. Within 14 days following the date of reception of the order, the buyer may therefore request an exchange or refund of the purchased item(s) without having to justify any reasons or pay any penalty. Since then, the items have to be returned in their original packaging and in perfect condition to be back in the market, along with price and date on the valid receipt. Beyond the 14-day period, Yodi will be free to refuse the exchange, credit note or refund. To exercise the right of withdrawal, the customer must notify Yodi (12 rue Vivienne, 75002 Paris – hello@yodibeauty.com) of his decision to withdraw before the deadline by means of an unambiguous statement (for example, letter sent by post or e-mail). In the event of exercise of the right of withdrawal within the aforementioned period, only the price of the product(s) purchased and the delivery costs are refunded; the return costs remaining the responsibility of the Customer. Customer are responsible for the cost and risk of returning the items to us. If the package is lost, stolen or damaged on his way back to Yodi, we reserves the right to refuse a refund. The exchange (depending on the availability) or refund will be made within 14 days after reception by Yodi of the product returned by the consumer under the conditions provided for in this article.

9 – CONFIDENTIALITY

In accordance with the "Data Protection Act" No. 78-17 of 6 January 1978 as amended, the processing of the client's personal data is governed by the CNIL and the client has the right to access, modify, rectify and delete data concerning him by contacting Yodi, 12 rue Vivienne, 75002 Paris - hello@yodibeauty.com. The Customer can subscribe to the Yodi newsletter and thus choose to be regularly informed of the offers. He has, at any time, the possibility to unsubscribe by clicking on the link provided for this purpose on each of the newsletters.

10 – INTELLECTUAL PROPERTY

The Yodi website and all the elements found on it, whether visual, textual or sound, are the exclusive property of Yodi. Any total or partial reproduction without agreement is prohibited and punishable by law.

11 - RESPONSIBILITIES

Yodi cannot be held liable for any events, inconveniences or damages inherent to the use of the Internet network, in particular in the event of a service interruption, external intrusion or the presence of computer viruses. In addition, Yodi shall not be held liable for the non-performance of the contract concluded in the event of fortuitous circumstances, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, floods or fires. Yodi shall not be liable for any indirect damages hereunder, business interruption, loss of profit, damage or costs, which may arise.

12 – GUARANTEES LEGALS

The products sold on the www.yodibeauty.com website are subject to the legal guarantee of conformity set out in Articles L. 217-4 et seq. of the Consumer Code and the guarantee against hidden defects set out in Articles 1641 et seq. of the Civil Code.
